RE: MY INVITATION TO THE NBA BENIN EXCO IN A HEAR SAY RUMOUR:ULTRA VIRES OF YOUR POWERS AND YOUR POTENT BREACH OF THE RULES OF NATURAL JUSTICE AND PRE ACTION NOTICE ON DEFAMATION OF CHARACTER OF DOUGLAS OGBANKWA ESQ
We act as Solicitors to Douglas Ogbankwa Esq.(hereinafter referred to as our client) We write this letter on his behalf.
Our client has briefed us as follows:
1. That our client was served by Whatsapp (An unofficial Mode of Service ), a purported invitation on an allegation that does not have a complainant.
That the NBA Benin Branch who sent the invitation to our client is the complainant, the investigator, the persecutor/presecutor and the Judge.
This is a patent violation of the principle of fair hearing-Nemo Judex in causa sua– No man can be Judge in its own cause; our client expect a body of lawyers to follow the law, however buoyed by your desire to do the biddings of our client’s traducers, you have abandoned due process and due diligence.
The NBA Benin has summoned two emergency meetings in three days – a Record of any of the 125 Branches of the NBA, because of our own Douglas Ogbankwa. It shows the level of pervasiveness and desperation by the Excos of the Branch to do a hatchet man’s job for external forces which is very sad.
The NBA Benin Excos is also not the body of Benchers , that Called Douglas Ogbankwa to Bar.We humbly urge the NBA Benin Exco to stop being a willing tool for politicians, who are hellbent on embarrassing our client over his professional Role in The Edo 2020 Elections. A finding of the NBA Exco can not equate to a validation of practice .
That our client nominated Pius Oiwoh as a chairmanship candidate and he was cleared. After serving his tenure the said Pius Oiwoh suddenly realizes that our client was not called to Bar. Our client contested for the Position of the Publicity Secretary of the NBA Benin Branch (2018-2020). You also appointed him as the Chairman of the NBA Bar Police Relations Committee.It will be very curious for you to making the unfounded and unguarded statements you made against our client and , you should issue an unreserved apology in writing .In order for you to create a non existencelocus , you hurriedly removed our client as the Chairman of the NBA Bar Police Committee , according to you based on allegations.You did not give him fair hearing and we wonder why you , after putting the cart before the Horse , is now inviting our client.What you and your Exco is doing sir is flagrant abuse of powers and our client is entitled to damages in a Court of Competent of Jurisdiction.
If one should look at your action before now concerning our client , one will wonder whether you do not have records or whether it amounts to unnecessary malice and vile for you to make such a wild allegation based on a letter you purportedly got from The Supreme Court without serving our client a copy of the letter, which is a denial of fair hearing. We ask that you steer clear of matters not within your Jurisdiction and that of the branch of the NBA can not embark on a vendetta case on a former officials who have served the Bar meritoriously without blame or blemish.
Callistus Ogiegbaen was called with the name above and he now bears Collins Ogiegbaen , I wonder why you did not question him on his name discrepancies. I advise the Exco to look at the many issues affecting the people of Edo State , which this Excos has been like a mere spectator. The situation is one akin to when Rome was burning and Emperor Nero was pursuing Rats. As We Speak there is a problem with the Federal High Court in Benin , Members of the Branch are having problems getting their stamp and seal, you chose to major in minor and minor in major.
Attach herein with is a screen shot of an exchange , today the 27th of April, 2023, between our own Douglas Ogbankwa and one Sandra Palmer Aghowhose Legal Consultant in a case I am handling is one CALLISTUS? Or Sorry, Collins Ogiegbaen.This whole issue is also connected to this Matterand Sandra has boasted that he will use his connections to embarrass me at the NBA , so I am not surprised.
YOU CHOOSE THE WRONG LAWYER
You are required to inform our client of the Complainant.It is sad that the same Pius Oiwoh , who complained that he did not know his complainant in a Petition orchestrated by his new found partners in their trail of impunity, could be going about bandying lies against our client.Whena thing does not favour a Politician , he becomes an activist. I ask for the umpteenth , who informed you, Mr Chairman Sir!
You can not debar a Lawyer you did not call to Bar.The NBA Benin has set a record of impunity on this issue.It is even professional misconduct, jointly and severally for Exco Members of the NBA Benin Branch, to assume jurisdiction over a matter , that is the exclusive prerogative of the Legal Practitioners Disciplinary Committee of the Body of Benchers.
The Legal Profession is highly structured and there are hierarchy of powers. Again, you are proceeding on unfounded rumours and beer parlor talk. Has the NBA degenerated to this level.Posterity will judge us all !Please fined attached NBA National Tag in the name of “Douglas Ogbankwa “, a Tag signed by Pius Oiwoh indicating that our client is the Secretary of the NBA Human Rights Committee and a Process Signed by our client , but not filed with other senior Lawyers , including an SAN.Be sure of your facts , ideals have consequence.-Primatus
