Court Orders KNSG to Refund Illegally Deducted Funds Back to Pensioner’s Account

AN Industrial Court sitting in Kano, has ordered the Kano State Government to refund to a Pensioner, Badamasi Umar all his deducted Pension Funds and henceforth stop further deductions.
The Presiding Judge, Justice E. D. E Isele, declared that all deductions made in the Pensioner’s Monthly Pension by the Government were illegal and should be stopped and refunded immediately.
The case commences by the Claimant in an originating summons filed on 31st December 2020, seek that his Monthly Pension amounting to N82,112.01 has been tampered with and such actions should henceforth be stopped and deducted funds illegally should be remitted back to his account.
The Presiding Judge, ruled that with regard to first headcount his N95,464.80 monthly Pension should be guaranteed and shall not be withheld or altered to his advantage in the light of section 210 of the Constitution of the Federal Republic of Nigeria (as amended).
That in the third head claim it is declared that upon construction of section 210 (2) and (3) of the Constitution the Claimant who has been receiving a monthly Pension of the sum of N95,464.80 from the Defendants is entitled to an upward review of his monthly Pension after 5 years or review of minimum wage as the management of economic shall permits.
The Judge ruled that in the fourth head of claim it is declared that by virtue of provisions of section 6 of the Kano State pension and Gratuity law 2007, the Claimant is entitled to prompt payment of his monthly Pension every month as at when due.
However, the Presiding Judge in the claim of damages refused the Claimant in favor of the Government, so also the claim for Punitive damages which is equally refused in the 11th and 12th heads of claim respectively.
Similarly, the Government defeated the Claimant claim for Costs as the Judge directed that parties should bear their own Costs, “judgement is entered accordingly”.
